    Default Step Parent Adoption, No Name on Birth Certificate

    My question involves adoption law for the State of: MN or WI

    I am getting married to the man that I have been with since my son was 6 1/2 months old. My son is almost 5. The bio father did not sign the birth certificate or recognition of parentage. He has never paid child support and is not on any legal documents whatsoever. We are planning on my husband to adopt my son. He hasn't seen my son since he was 2 months old. Do we have to notify the bio father? Is their a difference in MN or WI? We are planning on moving soon and am not sure which state is easier with step parent adoptions. If the bio father doesn't have any parental rights, how can the court terminate them?

    Yes, you have to notify the father. It shouldn't be too difficult to get the biological father's rights terminated given those facts.
