    Question Can a Spouse File a Judgement Against Another Spouse About Separate Assets

    My question involves small claims court in the state of: NC

    Me and my spouse are getting a separation and ultimately a divorce. He obtained a car prior to us getting married. I have the car, he has in turn cancelled everything on the car from the insurance to the license plates. The car is in his name. Since we have separated I have had the car for 60 days.
    My?is can he file a judgement against me for the car even though we are married and he obtained the car prior to marriage? If so, how long do I have for the judgment to take place? And what can I expect in court? Will they serve judgement papers at my employer as well. Any answers to these questions will be appriecated.

    The division of marital assets will occur through the divorce process. You will be served wherever you happen to be when they serve you.
