    Default Internet Harassment

    My question involves criminal law for the state of: PA

    10 months ago

    A juvenile scenario

    An officer arrives at a school and interviews both the ''victim'' and the accused both ages 15 and some other of her friends I think two he messed with but that was all random nonsense both of the students parents are present as well as the friends parents though the friends parents left early the accused states it was only a joke when asked and the officer replies

    ''you wont go to jail as long as you don't message them no more stay out of trouble there going to get a restraining order it will last 3 years (which never happened) stay out of trouble join a sports team or something so he agrees to abide by what the officer said during that time the other officer with him took the report and took a copy of the im conversation which nothing threatening was said just that he was the school stalker and he will strike again after being told to stop he was merely just fooling around

    when the officers were there the accused was also expelled from the school

    To this day nothing at all happened to the accused no court no arrests no search seizures least not from the accused end

    could it be possible that it is over and he should of learned from this incident or is the accused just going down later for this?

    all details have been provided and nothing was left out

    "Should have", the contraction of which is "should've". Arrgh.

    In the state of Pennsylvania, victims have up to two years to press stalking/harassment charges, so if you're meaning to get up to mischief, you're not at all in the clear. "It was just a joke" never flies, and only ensures that you'll be slapped down hard for any subsequent "jokes".

    You may check with the Clerk of Courts to see if you have an active restraining order against you, but long term orders are rarely executed without a hearing.

    but is it too late to mend ways as all the harassment has ceased or is it as long as nothing further is done all is fine?

    Being on the straight and narrow now does not negate the statute of limitations. You may yet still be punished for prior actions, until the SOL runs out.

    Consider it this way - if you've robbed a bank, you should be punished, right? It's illegal and there are consequences for such things.

    So, let's say you've robbed a bank, but you don't get caught right away. Immediately after robbing the bank, you realize you were stupid, give all the money to charity (or mail it back to the bank!) and never rob another bank again.

    But, a year later, you are identified and arrested and tried for the bank robbery. "But Your Honor, I've stopped robbing banks!" is not going to get you off the hook for the one you robbed.

    So it is here.

    Mind, if no charges have been filed in 10 months, I would personally think it unlikely that they eventually would be. HOWEVER - the law provides for them to still be filed for about another 14 months. Keep your head down and your nose clean and you ought to be OK.

    If charges were filed wouldn't they of made an arrest?

    they had probable cause at the time of the incident as it was admitted...seems like he was let off the hook with the whole ''you wont go to jail just dont message them anymore''

    or how would the person even know if charges were filed on them?

    If charges are filed, yes, you are informed of them.

    So if charges are filed in the next 14 months, you'll know.

    so your saying if they were filed I would of known and this wont be something that will pop up when adult age is reached?

    If something was to be sent it would be by mail im guessing?

    that sounds like a criminal summons

    what if it were a warrant would one still be contacted (or arrested) by now?
