    Default Videotaping Public School Events

    My question involves civil rights in the State of: Pennsylvania

    I own a small video production company. Besides the typical business clients (commercials) I also videotape high school sporting events, make a highlight DVD, and sell it to the participants and their families.

    At a public high school, to which I paid admission to enter, I was told I could not videotape the game due to privacy reasons, since I was not related to anyone participating in the game.

    1. Can I be prevented from videotaping an event on public school property?
    2. If #2 is no, can I sell a DVD I create from that taping?

    The school doesn't want you to film children to whom you're not related at school events on school property. You'll have to live with that.

    Have you thought about cutting the school in as a fundraising effort for the teams/events you are videotaping?

    Beats the heck out of buying wrapping paper and cheesecakes.

    How does that differ from someone taping the game for scouting purposes? They are not related to any of the players.

    Another thing I thought of. The local newspaper often takes photos of the games. I understand it being a newsworthy event. But then the paper will have those photos available for sale on their website. How is that different from what I am doing?

    Scouts generally have asked for and received written permission from the school to tape. Additionally, students involved in sports and certain extra curricular activities are asked to sign waivers allowing their likenesses to be used in the case of news or scout footage.

    They have valid press credentials and written permission to be there. You don't.

    I know for a fact that our local paper does not do this. My son's pictures have been in numerous times (for sports, not the police blotter ) and he has never signed a waiver.
