    Default Help with a Virginia reckless driving charge

    I was driving on 66 W and I had the flu. Just as I started to feel like I was going to throw-up, I hit grid-lock traffic. I noticed that the rest area was only about a mile away so I pulled onto the shoulder and drove past the traffic attempting to get to the bathroom. Two motorcycle cops pulled me over. I was obviously sick (I was dry heaving out of the door) and all they asked me was if I needed an ambulance. I told them no, I needed to get off the road and get sick and go home and get in bed. After a few minutes they gave me a summons to go to court and lectured me about driving on the shoulder. I am really scared because this is my first time having to go to court, actually, I have a clean driving record, only an HOV ticket when I didn't know about it, and my job depends on having a license. If you have any advice on how to deal with this it would be greatly appreciated.

    You can explain your situation to the court, and see if the court takes mercy on you.

    Well IMO you passed up on your best chance to get out of it....When the cops asked you if you needed an ambulance you should have said either yes or no, but you do need some medical attention and would like to see a doctor.....The reason I say this is if the cops realized that you needed medical attention they may not have issued you the ticket seeing as it was an "emergency" and in the event that they did issue you one I am sure you could go to court and the judge would dismiss it.....



    Now I know medical things in the US are not the same as in Canada as I have lived in both so if you would have had to pay out of your own pocket (no med insurance) for any attention you receive I can see why you declined it.....


    I am not a lawyer or anything and this is just my opinion.....
