    Angry My Bank Account Levied for a Truck That Was Voluntarily Given Back 7 Years Ago

    My question involves an auto loan or repossession in the State of: Alaska

    After 7 years does the car company have the right to take mine and my childrens money for a truck that was given back to Ford Motor? The company had been taking my husbands permenant fund dividen in 2004 and 2005 which was fine we wanted to make the payments on the truck after Ford had sold it but couldn't afford it. ( Hence this is why we voluntarily gave it back) They stopped taking his dividen and sold the paper work to some one else who never pursued it or let us know. Now the paperwork has been sold again and now they took my husbands dividen and also took mine and my childrens without warmning of any kind. They tell me because my husbands name is on the account they can take anything they want. They did not have authorization to levy my account. This money they took was for my children and I to be able to survive through the winter. now I don't know what I am going to do. Please HELP!

    you said it was HIS account as well. They can take his money, if the proper court procedures were followed.

    In whose name was the truck loan and in whose name is the judgement for the deficiency on the truck and in whose name was the garnishment filed?

    If you can demonstrate that the source of the money was not him, you may be able to recover the money by bringing a motion in the court that authorized the garnishment.

    The court did not authorize it this time and I have sent the proof that it wasn't his money that was levied out of my account. The original bill was for $6,000.00 and now to date they have garnished $16,000.00 as of The 12th of Sept. 2008.

    if their was no legal garnishment, you need to do some serious talking with your bank to find out how they releases the funds to the creditor.

    I am primary on the account his name is secondary for putting his dividend. court procedures were not followed the court was not involved this time the case has been since 2004. only His name was on the truck the deficiancy and yhe garnishment.
