Hi I'm the father of a 4 year old in Michigan. Me and my wife are currently going through a divorce. Right now we have Joint Legal and Joint Pysical custody. We split parenting time 50/50.
She has taken me back to court trying to get full custody of our son. We went thru the FOC evaluation and are not awaiting a response from them. I am very afraid that the response will not be what I want or what's in the best interest of my son.
My wife has recently agreed to keep Joint Physical custody with a 50/50 split if I let her have Full legal custody. My main concern is seeing my child but I dont know if it is wise for me to give in and let her have legal custody or not. I'm afriad if I do not take this offer then the court will award her primary physical custody and that I will not get to see my son as often.
I know what legal custody means for the most part as I have done my homework. I'm not real excited about not being able to access my sons records and giving up my decision making rights. I guess i'm at a loss as what to do. I am not happy with my attorney and do not feel as if she cares about my case one way or the other. If maybe some of you could give me the pro's and con's maybe I would feel better about my decision.
