    Default Accidental Diversion Violations

    My question involves criminal law for the state of: Kansas

    My story start's a little over a year ago. I was charged with a DUI that was accidental, I blew a 0.083 and was put on DUI diversion. Everything was going well until about 3 months ago, I got into a fight with my immature manager who had a crush on a girl at work that liked me and not him, he got jealous we were hanging out so much, and fired me for being two minutes late one day, I tried everything to get hired back, including talking to the owner of the resturant, didn't help. I thought I caught a lucky break and got a pretty good job a with a friend doing brick masonery, it was a good job and payed plenty to live on. A few weeks after I got the job I broke my hand at work, and I'm not getting workmans comp, not that kind of job. I couldnt work there anymore because I was in a cast, and I'm not supposed to lift anything heavy, so I went across the street from our house and filed out an application at 711, you know, the convience store, it didn't pay much (7.50an hour), and it sucked, but the people were nice there and it was an income. Almost a week after starting work there, I was sent to work by myself, I'm a pretty quick learner and I hand everything down so they figured everything would be ok, not the case at all. A few days after working alone I thought everything was going fine, there was a huge mid-day rush, and a person bought some beer, he was about 6'5, 250 lbs, dark skinned guy (looked middle eastern) with a stubbly beard. Ten minutes later after the rush had ended the cops came in, I had been set up by a police sting and I was being writen a sitation for furnishing alchohol to a minor, it was a total accident, and is at the bottom of the tier when it comes to furnishing to minors, but I'm on diversion for DUI, and I just got a letter in the mail yesterday about how their going to terminate my diversion for that, and not paying the 1344.00 fee that was due a few months ago that I couldnt pay because all of my money is going towards bills.

    I'm a good kid, I barely drink, I don't use drugs, and I do my best to stay out of trouble. I've come on hard times now, I could face jail time, and I can't afford that, I can't even afford an attorney to help me on this, I have a car payment, insurance, cell phone, rent and a ton of other household bills to pay. WHAT SHOULD I DO HERE?! Im screwed... I want to join the navy when Im done with diversion...

    0.083 is ridiculous... I had 3 beers, I didn't even have a buzz. The arresting officer later told me that if I would've urinated before driving, I probably would not have failed the breathalizer. I passed the FST easily, it was the breathalizer that got me. I think thats kind of unfair, how a person can pass the test with ease, and be arrested on a bs technicality. What really matters? The person ability to speak, walk, see and drive? Or numbers on a machine? That's an accidental DUI.

    In the future, please don't waste my time if you don't have an answer to the question.

    Yeah... That attitude is going to inspire people to want to help you.

    Get yourself a court-appointed lawyer, and when forming your strategy for court consider that the court is unlikely to be sympathetic to the idea that every time you break the law it's an accident.

    Attitude? I don't understand how a person can get a simple reply confused with giving a person attitude. And how are you going to lecture me about giving attitude, then come right back with an obviously rude attitude? Even if I did have an attitude, how are you any better than me? If you would read the opening post, you would clearly see there was no attitude whatsoever, and the reply was the one that was rude. But he's a senior member, and I understand this forum is probably consumes most of both of your lives, so go ahead and take sides, like an immature 15 year old girl would.

    Can I please just have a straight answer, without someone being rude?
