Default Left Hand Turn. 4 Way Stop

My question involves a traffic ticket from the state of: California.

Four way stop. I was making a left hand turn. To my left, as I was coming up to the stop sign, I saw a car turning right, into my side of the road ( going to opposite direction of me) so my view was clear that there was no other traffic in line on that side of the street. Ahead of me were no cars, and to the right on me were no cars.

So I roll up to the stop sign ( 1-2 mph) and check Right & straight one more time before making my left hand turn. Right when I turn, I see a Sheriff (He is about 20 feet back, from where that car had previously turned to make a right, parked next to the curb) I see him AS I am making the turn.

Without hesitation he turns off his lights and gives me a Moving Violation ticket for running a stop sign.

(When making a left hand turn from where I was coming from, you cannot see anymore than 10-15 feet to the left, because of a brick wall, and he used this to hide behind)

My question is do I have a fighting chance of this? This is my very first ticket for ANYTHING, and I dont know if it matters or not, but I was on my motorcycle(For those who will ask it is an 08 zx6r ninja)

I have talked to some people, and they said if I extend my court date, there is a really good chance that the Citing Officer will not show up to court, and my violation will be dismissed. What are the chances of this if it does happen?

No one here, or anywhere else, can tell you what odds are. But, if you can prove that from his sitting position he cannot see anything beyond a brick wall, then you have a good chance. BUT>>> again, no one can guess it out for you.

Postponing the court date is not a method of reducing the odds of the cop showing up. They can be scheduled anytime a date comes up, so just do it and be done with it.

Being on a motorcycle could work to your advantage in that coming to a complete stop and moving again can occur quite quickly, moreso than a car and you may try to demonstrate that you can stop and start quickly and the cop may have not seen you do so. I ride a ZX11, so I know how quickly this can occur.

Keep in mind, I am not an attorney, nor should my post be conscrued as legal advice. The best attorney to get answers from is the one you go see.

Will I need an attorney if I try to fight this? I did make a "Cali Stop" But do you think there is any way to stretch the truth abit more than whats obviously to the situation. Such as his view towards me, or the fact of no traffic whatsoever during the time I got pulled over.
