Child wants to live with father

My question involves a child custody case from the State of: MASSACHUSETTES AND MAINE

MY SON IS 10 YEARS OLD AND WANTS TO COME LIVE WITH ME. HE IS UNHAPPY WHERE HE LIVES NOW WITH HIS MOM AND STEP FATHER AND 2 HALF YOUNGER BROTHERS. HE NOW CURRENTLY LIVES IN MAINE AND I LIVE IN MASSACHUSETTES. I JUST WANT TO KNOW IS THERE A SHOT AT ALL THAT I CAN RECIEVE CUSTODY? THERE ARE STORIES THAT MY SON TELL ME ABOUT THINGS THAT GO ON THERE. THIS IS HIS IDEA TO MOVE WITH ME AND HE IS HEARTBROKEN WHEN HE NEEDS TO GO HOME. I AM IN NO WAY PUTTING THOUGHTS INTO HIS HEAD. WHEN I CALL HIM HE TELLS ME HOW UNHAPPY HE IS AND HE WANTS TO LIVE WITH ME. HE ALSO FEARS OF SAYING SOMETHING TO HIS MOM ABOUTH THE THINGS THAT GO ON UP THERE BECAUSE OF THE STEPFATHER. HE HITS HIM AND ALSO MENTALLY ABUSES HIM. THE STEPFATHER IS AN ALCHOLIC AND I DONT FEEL SAFE WITH MY SON THERE. ANY IDEAS ON IF I NEED TO GO TO COURT HERE IN MASS. OR IF I NEED TO GO TO MAINE? AND WHAT ARE MY CHANCES?

You can file in the same court where the existing order is located.

If you go into court fully prepared with evidence of why the change will be in your son's best interests, and hire an attorney your chances are at least 50/50. A local attorney will be able to look over your order and your evidence and be able to give you a more accurate idea of what your chances are of prevailing in court.
