Take a video or screen print of what the camera can see with you to court. If the question here is; "Is this camera invading his privacy?" then the answer will depend of what the camera can see.

If you say the sound is disabled then that's that - it's up to the neighbor to prove that it *does* record sound.

    Update:
If I goto court, is it recommended I have a lawyer present, or should I just represent myself? I'm really not looking forward to paying attorney fees for trying to protect my family.
Honestly, that's a relatively small price to pay for peace of mind and security. Consult an attorney and follow his/her advice.

I have a security camera but no one knows, it's not hidden but it's hard to spot because it's just above the security lights. That camera has witnessed

#People breaking into my neighbors house
#Someone side swiping my daughters car
#The legally drug addicted neighbor whom in 15 years I have never seen sober and whose home I saved from burglar backing into my van but swearing he didn't even though there was paint on his dented bumper and the police found his car keys in the street.
#Him and his sister driving off in the car that would take her life because he is so stoned his reaction time can be measured in tens of hundreds of seconds (he lost his license - for 6 months)
#The ambulance and fire truck coming to pick up my neighbor in the middle of the night 3 times a year
#Me in broad daylight in my underwear shooting his rottweiler with a Beretta Tomcat .32 which it turns out is no good for shooting dogs At least the report scared him away and made sure EVERYONE saw me in my underwear. Of course the child I was protecting was long gone.
#Someone breaking into my van stealing my stereo sub-woofer, DC converter, passport, garage door opening etc.
#Someone shooting out my rear van window with a BB gun (someone has it out for my van)
On and on and on. But not one of those things was recorded because I didn't buy the VCR!

A video camera is no good unless it records sound and video.
