My question involves a roommate in the State of: CALIFORNIA
My name is on the lease as well as my old roommate who no longer lives at the apt. The lease is month to month (been living here for 4+ yrs). The person that moved in was a friend of hers that I knew. He has been an okay roommate for over the past yr.
My BFs lease is up at his place and wants to move in with me. Although we want my current roommate to move out and turn the second room into an office. Do I have a right to ask him to leave?? 30 days notice? He is not on the lease.
Although I never told my landlord I had a new roommate since my old one moved out over a yr ago. He has been writing me the check for his portion of his rent since our property management company will only take checks from tenants on the lease.
We never really verbally agreed on anything. I trusted my old roommates decision on him moving in and had met him a few times before so i went for it (pretty laid back here). He isn't all that bad of a guy. It is just that me and my BF want to live together now in this apt just us. (rent is cheap and it is a big place)
What are my options if he doesn't want to leave? I am the only person on the lease for the apt now month to month. Can I get him evicted through my property management company? Or will I get in trouble from my property management place since I never disclosed a change of roommate?
