    Default Moving While on Probation in Florida

    My question involves criminal law for the state of: Florida and Kansas

    I'm on probation in Florida but my sending state and the origin is Kansas..

    I moved to Sebastian before my trial and started a job and had family so they allowed me to transfer.. While I was here I met my fiance' Kristee abd we are now expecting a kid together in November 08'..
    We had some issues with her family(whom we were staying with) and they vandalized the place we were all staying at.. I called to tell the landlord so he knew it wasn't me being that it was my room that was broken into while we were away.. Well after they did it I assume they called and said I did it.. so much to my surprise when I called.. the landlord jumped all over me and threw me and Kristee out with only some of our stuff into the pouring rain at about midnight.. I couldn't do anything because my name wasn't on the Lease..
    Thankfully I have good friends.. My good friend Devin came down from Orange County (75 miles north of where we were) and got us.. So basically I violated prabation overnight.. I called my P.O. in Indian River County and explained to him what happened and he's a good guy so he helped me transfer to Orange..
    Well I'm here in the middle of no where.. and thanks to my lovely future in-laws.. I'm hundreds behind in P.O. payments because I have no job.. I have no way to a job.. The only way I make money is working for my friend doing odd jobs to buy food.. With this kid coming this isn't going to cut it and I'm soon going to end up in jail and I'll miss the birth of my baby.. They got the ok from Kansas to give me travel permits to go to VA(because I didn't want to move from Florida permanently.. only to make money to get a home and a car so we would have transportation) The thing is.. being behind in money they won't let me go until it's paid.. but by then I'll be off probation..
    I have family up there who have already offered us a place to stay, 2 job offers, and transportation to and from..
    Is there any law saying that they have to let me go or that can help us get there..? I'm scared to leave her and the baby and miss my kid being born.. It's tearing me apart.. and aside from jumping probation(which isn't smart) there's not much to be done that I know of..
    Any help would be GREATLY GREATLY APPRECIATED!

    I was also wondering if maybe there was a way to ask for any sort of probation formal or informal that would reduce the costs.. The whole reason I'm in this hole is because I cannot get a job here and I cannot move to VA to get one.. Therefore cannot pay.. I signed an extension for kansas of my probation and it appears to say that I'm only on probation until I complete my payments.. In the mean time they're still stacking up uncontrollably.. How should I go about asking that this extension be free with the terms of me paying..? There's no way around it.. I either go to jail and miss my kid being born or move to VA.. I would like to not have to risk anything.. I've worked to keep a clean life.. I moved and left all my trouble making friends.. I just want to settle down with my family.. but I WILL NOT miss my child being born.. period.

    I'm not an expert, but the most logical thing to do here is to get a job. You don't say why you can't get a job - is it due to your conviction?

    Because, that shouldn't stop you. My husband served 10 years in prison for a 2nd degree murder charge. He got out, worked hard, and within a year became the General Manager of a large business ( I won't name it here), making $65k per year. He now owns his own successful contracting company.

    It can be done. Work at McDonalds. Your fiancee needs to get a job too, and public assistance. She should be able to get on Florida WIC since she is pregnant, as well as food stamps.

    nope.. I'm in the middle of no where.. I can do odd jobs here but it doesn't cover food, probation, gas to store and appointments, etc and soon a baby and all of it's needs.. I have no way to and from.. our only hope is to get to VA.. I have friends and family there.. and there are alot more jobs in that particular area then there are here..

    I was charged with Burglary of an Automobile.. A felony..

    Is there any law that would allow me to leave? I'm on probation in Kansas but supervised in Florida.. Florida however will NOT let me go.. I signed a paper extending probation for 1 more year (Sep. 09')..-



    Can they legally hold me here until I'm screwed? That's just as morally messed up as when I acted a fool and stole stuff back in 2007.. If the law really is there to protect people.. and probation and parole are to give people a chance.. Why do I have to stay here and face jail/prison..? Just because I messed up once.. I get to sit here while they destroy the life I've been working towards.. It's really pathetic on their part... that's my opnion..

    I agree with you, I think the system is very flawed. I came very close to a probation violation, which would have extended my probation at least 6 months if not a year which would keep me from transferring to a university out of state next year. Just because of some Mip's. But just locking me down in Michigan should be a crime in itself, worst state economy in the country, keeping someone from living their lives such a minor offense is flat out wrong.

    that sucks man.. so it pretty much doesn't look good for me.. I would gladly take jail, if I didn't have a kid on the way, just to get it over with.. I'm kind of sick of their wanking me around.. I've not even mentioned to them that they never charged the other guy in the crime we did.. I love this country.. but government workers have lost all morals.. did they forget that they were here for protection NOT destruction?.. Yeah I did it.. but unless they want people to continue ignorant paths they need to get their acts together.. people will only take it so long..

    I'm working on paying as fast as I can.. but in the mean time I have $75 more racking up every month I'm on probation still..

    Any laws, anyone? Anything that would help me? Please?

    Nope, sorry. If a judge won't allow the move or your PO won't recommend it, then that's that.

    You could try consulting a lawyer and see what your options are but there is no law to help you.

    Would/could a judge decide otherwise? My officer in Kansas(sending state) has no problem with it.. it's the guy here who's holding us back..
