    Question Am I Being Discriminated Against?

    I am (Woman, Asian) working in my company for over 11 years , they recently open a new position similar to my Job with less responsibility, and hired a White Male for the said Job and paid him $4k more than I am getting.

    Am I being discrimated (Equal Pay Act of 1963)?

    Most likely the company is going to say he is best qualified bc of his qualifications, you however are probably over qualified bc you have more responsiblity and have established that. They have a right to negotiate his pay with him. It may also be a policy violation if you are aware of his pay so be careful who you disclose this information to.
    Have you asked why you were not given the position? Why would you assume that it's because you are an asian woman?

    It is an unfortunate fact of life that due to market compression, it is quite common for a new employee to be hired at a higher rate than those already employed, even if they are doing the same job.

    I know how much he's getting paid because it's part of my job… I'm in accounting. I do payroll, budgeting and such. I do not know his exact qualification though. But I know when they posted the job, they don't even require the same stringent qualification as they required for my position. I did not applied for it as it seem to be a demotion.
