    Default Arrested for a Probation Violation - What Next?

    My question involves criminal law for the state of: NJ.

    I have a question. Back in 2006, my boyfriend was arrested for a bench warrant. He received the court notice date a week after the scheduled date and for whatever reason never took care of it. The hearing was for violation of probation for not paying fines. He paid the fines one week after jail and was told he was off probation. Since than he moved, only several min down the road but different address. Last week he had to go to court for a family matter with the mother of his child. It’s a custody case because the state has declared her an unfit mother. Two days after that, they picked him up on violation of probation. He fully believed he wasn’t even on probation! The jail said he’s there for two bench warrants and there is no bail. I am in NJ, if this helps. What is going to happen? How long is he going to be in jail? I fully believe 100% that he did nothing wrong. He never received anything to go to court, or he really would have went. He changed since the first time he went to jail (weapons charges.) It scared him straight, literally and now he never even jay walks! I live with him and am very aware of the mail, etc. I cannot believe they said no bail. Any advice?? What is he facing? We are pretty poor so he might have to just have a public defender..

    How long is he going to be in jail?
    We can't answer that for you.

    Really, we can't do much of anything for you, as we know absolutely nothing about your boyfriend's situation. He needs a lawyer, he needs one now. If he can't afford private counsel, a PD will get the job done and he needs to see about getting one.

    thanks. he is getting a public defender. he got arrested last thursday but hasnt seen a judge yet (they said probably by the end of this week). i am just reading other posts about bench warrants and this just seems so dragged out!

    I still need advice. The reason this was placed in sentancing is because I had a question about sentencing. He was arrested Sept. 4, was denied bail twice and is going to sit there until at least Oct. 23 where he might recieve a one year. all for two bench warrants for court notices he never recieved. i have seen similar questions posted on this board and advice was given. all i want to know is if this seems out of the norm? he paid everything, he has not done anything stupid, they just showed up and arrested him. this really does not seem fair. i do not make excuses for his past but this time it seems overboard.

    The reason that he didn't receive bond is that he didn't show up for the last court appearance. The court wants to make sure he makes this one.

    You know he has a great excuse. The court, as yet, does not.

    Thanks for responding. He spoke to the judge at the bail hearing, it is his probation officer whose holding him. The same one who said he was off probation, the same one who didn't know he was in jail, the same one who told me she didn't know he had a warrant and the same one who no longer answers my calls. Nobody is telling us why he's there still. We heard it was two bench warrants but we don't even know why he possibly could have went to court. This is so frustrating because nobody will tell us anything. He was denied vistation, he only had two pieces of paper and one envelope to write and when he had his phone call, he still didn't even know why he was arrested, other than violation of probation. I have no idea how to find a lawyer, how to know if one is good, how much one costs. I'm not trying to be a pain, I just really don't know what else to do. I call his probation officer everyday. I have seen many people with bench warrants be released on bail or ROR. He paid $7,000 in fines in the past. I don't know what else they want.
