    Question How To Vacate an IRS Tax Lien Erroneously Filed, Then Released

    My question involves vacating an erroneous IRS judgment in the State of: CA

    The IRS filed a $20,000 Tax Lien against me in LA County. My accountant immediately called them, and within 6 weeks, the Tax Lien was Released (without payment) and the net effect was that the IRS owed ME money from that period. In fairness to the IRS, the confusion was caused by Putnam filing in incorrect 1099, then issuing a corrected one (which the IRS claims they never received). The problem is now my credit scores have plummeted. All 3 credit bureau's list the Tax Lien as filed on April 28th 2008, and Released in early June 2008. How do I get this Tax Lien Vacated (which is the only status that the Credit Bureau's will recognize as a deletion)? The IRS knew I lived in West Hollywood (I have mail from the IRS from 2006-2008 in West Hollywood)) and the IRS pulled my credit records on April 7th 2008 (which lists my West Hollywood Address as current) yet they chose to file the notices and Tax Lien on a prior address (either Santa Monica or NY, where I had moved from 3 and 5 years prior, respectively). Frankly, it's almost as though the IRS tried to serve and file on purspose to an address they know I had moved from. I contacted the IRS Agent listed on the Tax Lien who said that it is within the IRS rights to serve at my last known address and he refused to issue anything other than a Release (a ridiculous position, since I had IRS mail at my current address for the past 3 years). I didn't want to argue with him, so I ended the call.

    Any advice on how to clean this up, or who to hire to clean this up - would be much much appreciated. This is the ONLY mark on my credit record but it is killing it by about 100 points and it is impairing my ability to rent an apartment or buy a home. Of greater concern is that Tax Liens stay on your credit record for ten years. Any help appreciated.

    This is a perfect case to take to the Taxpayer's Advocate. They are a separate division within the IRS whose job it is to resolve these kinds of issues.

    They should be able to help you get it straightened out. However, if money isn't tight, I would recommend having a tax professional assist you with it.

    If you decide you can't afford a tax professional's assistance, then go to irs.gov and type in "taxpayer's advocate" in the search engine, and you will find the contact information for that division.

    Thanks for the suggestion, didn't know Advocate existed. I will absoutely use a professional (if anyone on this site can recommend anyone in LA, much appreciated). If I employ Taxpayers Advocate - can the original Agent get annoyed and retaliate subtly (Ex. Audit). I would clear an Audit fine - but it would be a pain to deal with as I have a hectic job.

    No, an IRS agent cannot do that. That would be one quick way for an IRS agent to lose their job.
