    Default Charged Due to Identity Theft

    My question involves criminal law for the state of: nc i have had my id stolen and the guy has used my name, ss#, dl#,address and other info to get hisself out of trouble.he gives law enforcement all my info and i have the charges in my name.i have gone through all the channels to try and clear my name, even as far as attorney generals office of nc.seems like the thief(who i know ) has more rights than i do. i hired an attorney, but after 3 months of doing nothing, i got my $ back. he relayed to me in our cons. that it should be no problem getting this guy arrested and charged for HIS crimes. funny!! anyone have any help with this problem? i dont have the $ to pay for something that i didnt do .contacted all credit, ss office, dl office, but figured att. gen.would do something more than sending a packet for id theft. any help would be appreciated!!!

    Hire a different attorney! It's a rather serious thing to have charges out there with your name on them, when they aren't actually yours.

    Presumably, you've already filled out the necessary paperwork with your banks and such so you're not held accountable for credit he has obtained in your name?

    And presumably you've also made a police report about the identity theft.

    Why do you still have charges in your name? Is it that the police and prosecutor think it was you, and that you're making up the identity theft claim?

    police reports, fingerprints and everything,att in one county told me to pay him 400$ and he could take care of the one in his cty just by (HANDELING IT IN THE HALLWAY WITH THE JUDGE).I didnt do anything so I am not paying,If Ipaid for an att in every cty he has charges in i would have to sale my house!!!!and the police know its not me bacause nearly every officer i have talked to knows that i dont have all the tatooes this guy has!

    So...what is it exactly that you want US to do for you?

    You're not going to get anything accomplished by stomping your foot and yelling "I'm not gonna pay!". If you want this resolved, you need to hire an attorney. Those do unfortunately cost money, but they cost far less aggravation than if you just leave this mess to fester.

    Take the thief to court later - if you're lucky, you might even be able to collect on a judgement.

    What happened when you made a police report about the identity theft? What did the police and prosecutor say when you offered up your fingerprints, and to let them see that you don't have the tattoos they recorded for the person who used your identity?

    The Attorney and Detective said "I should sue the State of NC for not taking care of this problem when they had the chance in 1999."
    According to the Detective then he was going to take care of it and clear my name after he ran my finger prints against the guy who is stilling my identity.
    I did not know until recently that he had been using my name again and had charges in my name in previous years. It wasn't until after a job search that I found out that he was using my name and information again. You really can't do anything to a person who has never had a job and who stays in jail and prison. All the attorneys that I have talked to said that I would have to get attorneys in each county where he has used my name, If I go to the magistrate and tell him who I was they would throw me in jail because my name is on the warrents.
    How would you suggest a person living from paycheck to paycheck to pay for attorneys in 22 counties?

    Aaron: Police in one county said to get an attorney and attorney said to go to each county and talk to a detective.I have police reports, my finger prints, and all the warrants.
    Is there not a victims advocate or someone who can help ME the victim?

    You can contact each involved prosecutor's office to see if they have a victim's advocate who can help you.

    If you didn't know that this person was using your name and identity over a nine year period, and made no report of it to the police, how were they supposed to have known? You say you have a detective working to clear this up for you, suggesting that you've made a police report. Why isn't that working out for you? You were told that you need to get in touch with the detectives who are responsible for the cases against this person (in your name) to clear things up. Why haven't you done that?

    Why not put together a letter detailing who this person is - their name, address, where they can be found - along with details about yourself, the name, agency, and telephone number of the detective who was helping you and the fact that he (I'm assuming) has your photograph fingerprint card for verification that it was this other person and not you, and asking what else they require to help clear things up. Then sending it to each involved prosecutor and police agency.

    mr know it all you seem to have all the arrogant answers the attorneys do! if you actually read my post ,you would have seen that in 1999 the det, in one of the cnty told me he would take care of it since he turned my fingerprints and all in to the sbi. i had no other reason not to think that he wasnt telling me the whole truth.not until this year when i found out we were losing our jobs did i know it had not all been taken care of.if you knowitall then why do you want to ? everything? its hard enough to try and talk to detectives when you have to travel all over nc.you have to make appointments and when you get to one that person is in court, no longer working ,or many other things. if you were in my shoes you would be kinda pissed at how our system works for the innocent.the fbi says that id theft is the #1 crime in america right now,but no one wants to take the cases!!!!
