    Default Landlord has raised the rent. Legal?

    I just received the new 1 yr lease they want me to sign and they want it back within 30 days. My current lease is not up until March of 2006.

    In this paperwork they also say the rent will increase $50 per month in 2006. Can they increase the rent legally before my other lease is up?

    Also, where can I check to see if this area is rent controlled?

    What if I don't sign this new lease? Do I then become a month to month tenant or do I automatically enter into another 1 year lease anyway?

    Default Rent Increase

    Any rent increase during the current lease term will be governed by the terms of the lease. So check your lease to see if an increase is allowed.

    Call your city or township hall, and ask if any rent control ordinances apply to your unit.

    Here's that portion of my lease. Looks to me like they can increase it whenever they want. Am I correct?

    As already discussed, any increase in rent would be governed by your current lease, but it is unlikely that any increase in base rent that is allowable by the lease would be enforceable or may not create a valid contract in the first place.

    Check your lease about the renewal process. You may be required to accept the new lease or tender notice no less than 30, 45, or 90 days before the current lease expires, so the request to return the new lease in 30 days may be reasonable.
