    Default Emancipation in Minnesota

    I live in Minnesota. One of my friends is 16, and she live with her mother, her sisters, and her brother. Her mother has made plans to move to Kansas, and she doesn't want to go. Her step-Father and her mother got a divorce, but he is the closest thing to a father she has. He has a house, a job, and can support her. She would like to live with him, but her mother won't let her. Her real father is a deadbeat, and she only talks to him when she is forced going to. She knows what college she is going to, she knows what she wants to do, all of her friends are here. She has planned her life in MN. Can she get emancipated from her mom, and life with her step-father? If not through emancipation is there anyway that it can be done? Please i really need some help.

    What are some of the general rules on how to get emancipated in Minnesota?

    The child must be a resident of Minnesota
    The child has to be at least 16 years of age
    The child must be living separate and apart from the parents or guardian
    The child must be capable of supporting himself or herself financially and managing his or her own affairs
    Each parent or guardian must consent (although there are certain exceptions)
    Not a ward of the state

    Thanks. but i have read all of that. i just cant make sense of it. Im trying to figure out if it is actually possible.. or maybe some other options.

    Unless she can show the courts that she is supporting herself 100% and living out of her parent's home she will not meet the requirements for emancipation. So that means until she's of legal age she moves where her Mom tells her to move.

    Is there a way that her X-step father can get custody? Maybe adopt her or something? Or do you have any other suggestions? Or is it just hopeless?

    Unless her step-father adopted her he has no legal standing in this.

    I know a relocation is difficult but it will only be as bad as she makes it, until she reaches the age of majority her only option is to move with her Mom and then when she's old enough she can move back to Mn if she still wants to.
