    Default How to Request the Credit Bureau to Remove an Incorrect Record

    My question involves collection proceedings in the State of: AL
    I refused an overcharge from a long distance telephone company. The telephone company hired a Collection Agency to try collecting the money. I reported the Collection Agency about the overcharge by my correspondence within 30 days with a refusal. But, I found my credit report has been recorded this collection amount. I have contacted the credit reporting agency. They notified me they had contacted the collection agency. The collection is valid. Although I have requested the credit reporting agency to add my notes dispute the collection, is it possible to request the credit reporting agency remove this collection record?

    Only if the collection is invalid, which it is not.

    You can certainly steadfastly refuse to pay the collection, and the CA can continue to report the debt. If you want it off your report, you'll need to come to an agreement with the CA.

    “Valid” is just the collection agency’s opinion. Why must the credit-reporting agency listen to the Collection Agency but ignore the customer’s disagreement? In fact, it is invalid because it is the overcharge. Has the collection agency violated the law or they can do it although the customer does not agree with the collection with a refusal within 30 days? Can any legal expert explain it?

    Just because you don't like the answer you got, does not make it wrong.

    You say your phone company overcharged you. They apparently believe they did not, and when you did not work out the situation with them, they sent it to collections.

    The time to have sorted this out was BEFORE your phone company sent you to collections. You didn't, now you have to deal with the CA.

    The CRA's do not answer to the consumers - they are information clearing houses for creditors to help other would-be creditors decide whether or not an applicant is a good credit risk. If a company says you owe money and they can prove you do, then the CRA will report it.

    Unless and until you come to an agreement with the CA such that THEY neither report the debt as paid or agree to strike the entry, that entry is staying put.

    But hey, if you're unhappy with this answer, you can always pay an attorney to tell you the exact same thing - with bigger words and a bill for services rendered.

    Actually, if the consumer sent his dispute to the CA within the 30 day limit, and the CA did not provide the validation documents, but instead reported the tradeline to the CRA, that is indeed continued collection activity. This is an FDCPA violation.

    Also, if the consumer disputed the debt with the CRA, the CRA contacted the CA to have the trade verified, and the CA verified the tradeline with out a remark that the tradeline is disputed, the FCRA has been violated as well. After all, how can the tradeline be complete and accurate if the disputed account is not marked as such? This is also another FDCPA violation.

    All of this can be used in a lawsuit against the CA and possibility the CRA. I would do this in a separate action in federal court. If you build a good case, tradelines like this can be removed. It just depends on the exact facts in question, and there are not enough facts to tell you if this particular case is solid, but in general it can be done.
