    Default Grand Theft Felony Warrant and Traveling Abroad

    My question involves an arrest warrant from the State of: California

    My friend got arrested a few months back on a grand theft shop lifting charge. He got bailed out but left the country to flee the consequences but really wants to return home. He is now afraid to enter back into the USA with this warrant but would like to resolve the matter. He has a juvenile record for robbery.

    Is it possible to get apprehended when traveling between countries in south or central america?
    What is the possible jail time he could be looking at if he is apprehended?
    What are the chances he can get through US customs without being arrested?
    Are authorities looking for him or is a bench warrant where they arrest him if he eventually runs into the law again?
    Can someone please give me some advice and scenarios so I can help my friend make a decision?

    If not in the US, no.

    That depends on the specific charges. It could be probation, it could be prison ... no way to know without knowing the statutes he is charged under.

    I'm not a bookie, I don't know. If the CA agency has not entered the warrant into NCIC for extradition, then it's pretty likely he wouldn't be nabbed at the border.

    A bench warrant is an arrest warrant - they will be looking for him like anyone else with a warrant.

    Your friend might consider hiring an attorney before he comes back. If he is not a citizen of the country, he might find himself deported if convicted. In any event, having a warrant in this country will restrict access to employment, government supported loans and social benefits programs (welfare, SSI ...), not to mention the possibility of detention by the police all the time - even if not in CA and they do not want extradition.

    is there a certain level of crime that gets your name put into the ncic system or is it random?
    do you think a grand theft charge with a failure to appear in court will get your name in the ncic?

    It depends. An agency will enter a warrant into a state or federal database (such as NCIC) if they are willing to extradite the individual. Such an entry generally is regional or gives limiting factors as to extradition such as only from the west coast or from certain parts of bordering states. Rarely are misdemeanors entered into NCIC for out of state distribution, but most felonies are. However, even many felonies are not serious enough to want to extradite so their entry into NCIC will generally include a command for regional distribution or text that explains where they will extradite from.
