    Default Cannot Emancipate in Michigan

    I'm 14 years old. I live in Michigan. And I've done tons of research on the guidelines and requirements to get emancipated. But either the text too hard for me to understand. The words to big. Or I flat out don't understand. I live with my mom, step-dad, and 2 brothers. One of which just recently moved in with us. Due to family problems with his dad (he's 7). I'm verbally abused constantly by my whole household. And physically abused by my 13 year old brother. He wraps phone cords around my neck until I pass out, shoves me down the stairs, and locks me out of my house in the winter time with hardly any clothes on until I give him $50, and the list goes on. I'm told that no one loves me anymore, I'm a horrible person, I'm going to be put up for adoption etc. well I am forced to spend every other weekend with my dad, who lives 45 minutes away from my moms house. There, I stay with my step-mom, baby brother, and my dad, and occasionally my other brother who lives with me at my moms. Well there I am physially abused, by my dad, he slams me against walls, smacks me, punches me, he's handicapped and has crutches so he'll sometimes hit the back of my legs with those. And it's over things I did not do, such as bad traffic, the power goes out while he's typing an important paper. Stupid things as that. Well lately, I've been having a really hard time, and I've been researching online and walking to the public library that's 5 or 6 miles from my house. But I have found nothing useful to me. I don't understand any of it. From what I gather though. To be emancipated in Michigan without being married or being in the armed forces, you must be 17. I have no other family members to go to. And only 2 of my friends drive, but they always have to work to pay for college and bills. So I have no way of getting away from my home life. It's currently the middle of a bad winter. So I can't sneak out and walk to a friends house. Considering I have none that live very close to me. I've also looked into nearby states emancipation laws and requirements and such, and they're all pretty much the same, you must be 17 (or older) to be emancipated. I need help. I need to find a way to get completely out of my family life.


    Does anyone know how I can do that?

    Also if I can do that, I would be able to get a restraining order against both of my biological parents correct?!

    You need to try to get help, perhaps from a guidance counselor at school or through the Family Independence Agency in your County.

    you need to call the police next time anyone touches so you can have witnesses.. then they will know what to do

    Several parts of what you have said upset me, if you are being hurt and abused mentaly or physicaly, why haven't you contacted athorities? please the next time someone hits you, especially a parent, call the police immidently. Also emancipation in Michigan is at the age of 16 and has nothing to do with what your situation is, Emancipation is telling a judge that you can financially and emotionally take care of yourself and that you are mature enough to know what that means, also you must continue school. I think it would be so much easier for you if you went through social servises instead and found someone to take care of you, and then you could live with them finnish your school ect, also if you go through the police and social servises it is cheeper ( $100 fine just for filling for emancipation) and you would have a much better chance of getting a restraining order, or at least a judge to tell them verbally to stay away.
