It absolutely is a good argument if the cop claims to have paced. Hence, the discovery request.

I was responding to your purported defense of "I didn't have time to accelerate". That's different from "I did have time to accelerate, but you didn't have time to pace me."

I have 3 more question regarding this. 1.) The officer wrote that I committed the offence at 12:20. He pulled me over at 12:22 one mile away according to the police logs. Isn't there a way to determine the speed of the car by the lenght it traveled?

2.)Should I wait till i go to the court day to file discovery ? Is it too early to do it?

If it really was a school zone, he doesn't have to justify the speed limit and speed trap laws don't apply. Your best bet is simply to show that from where you were at, you simply did not have time to accelerate to 45 at the location of the violation. Even if you did, the officer certainly wouldn't have time to pace you.

Do yourself a favor. Request discovery now so that you can tell if he paced or estimated your speed. You can get instructions here.

No... you use the discovery to determine what kind of case you will present. You first must understand the evidence that will be used against you before you can make a defense.

Request the discovery NOW... ask for an extension on the arraignment (just call the court, they will give it to you).
