    Default Can Back Support Be Paid at a Lower Monthly Rate Than Current Support?

    My question involves child support in the State of: Tennessee.

    Can back support amounts be paid at a lower rate than current support? My child is now 18 and in college. I received a notice that monthly payments would be $100 instead of $440. The non-custodial parent has not had a change in income. The back support amount is over $52,000. The support payments are definitely needed for our child's monthly living expenses. I have requested an appeal. Is there nothing more that can be done?

    Often times CSE will leave the support payment the same in order to pay the arrears down quickly. In other instances, they reduce the payment to what he was paying towards the arrears only. Sounds like they chose to do the latter. You can always take the matter to court and let the judge decide what the new payment should be since the (now) adult child is emancipated.

    Thank you for your response. Hopefully the appeal process will help in getting this resolved in a timely manner. It would take over 43 years to pay the back support amount at $100 a month.

    Well all you can do is ask the court or the agency to reconsider their decision. However, your child needs to be paying his own monthly expenses and you need to be prepared for the fact that their decision may not change.

    One option would be to have the Court enter an order wherein the current support would remain at its rate and then have the arrearages set at a different rate to be paid out over time--this would be normally done by agreement. It would need to be made clear what payments are for current support and what payments are for arrearages.
