    Default Voluntary Repossession - How Long Does It Take?

    My question involves an auto loan or repossession in the State of: Mi.
    I went and filed for Chapter 7 bankruptcy protection on 8-18-08. I have a 2002 Envoy that I am surrendering and am 2 months behind on the payment, approaching 3 months. On August 19, I called my bank and told them that I am voluntarily surrending the vehicle and to come and get it. They said they'd call me back.

    The next day a different person called me identifed themself as a supervisor, confirmed what I said about the voluntarily surrender, and asked me verbatim "where is the vehicle right now?" I told them in my driveway and come get the PIG as I have no insurance on it and its a liability on their part.

    This morning I am leaving for work, I am driving a relatives car, there is a truck sitting in front of my house (pickup truck NOT a tow truck) with a guy on a cell phone looking at a clipboard and looking at my truck. I left for work but felt uneasy so I turned around and came back home. This time the truck was next door but still on the phone and still looking at my truck.

    For the record, the truck is in my driveway in an accessible manner, as I want the truck gone so I can start a new chapter in my life. I just moved the truck into the street so they can get at it easier. Maybe it was too difficult to get a tow truck in my driveway. I dont know.

    Tonight there are 2 vehicles parked down the street and a guy walks to the front of my house. My roommate is on the front porch smoking (sorry no smoking in the house!). The guy sees my friend, raises his hands like "I dont know" to the other guy down the street, turns around and leaves

    Basically Im thinking the repo guys are here but they, for whatever reason, havent initiated conversation with me or are trying to sneakily take my truck. I will gladly give them the truck, all keys, the title. Are they just going to tow away the truck without talking to me first? What about my license plates? Ive cleaned it out already completely so my personal effects are all in my possession.
    How long after I talked to them last (8-19) are they going to wait to take my truck? Whats the usual turn around time?

    They cannot repossess your vehicle until they petition the courts for a relief of stay and the courts allow them to take it. It will be sitting there for at least 45 days, I'd say.

    Ok but my Lawyer hasnt filed the chapt 7 papers yet with the Court ...in the next few weeks he will. Have a lot of stuff to get in order first. However, the Lawyer did take all of my bills/creditors/secured and unsecured debt and sent letters. Im assuming cease and desist letters?

    Either way, does that make a difference?

    My response was on-topic. You changed your story from your first post. All I did was point that out. If that makes me rude, then so be it.

    But, the truth remains: We cannot answer your questions accurately when you provide information that is conflicting.
