    Default Starting a Corporation

    I may be filing for divorce in near future but am in the process of starting a corporation in TX.

    Is there any safe way to structure a corporation so that youa re not susceptible to community property ?


    I mean can you name it after a family members name or something.

    That would likely be ineffective.

    You could look into having the shares of the corporation held by a trust, and structuring the trust such that it is not accessible as community property. That, however, is something that should only be done with the assistance of a legal professional with a strong background in both tax and trust law, as mistakes could (a) cause you to pay extra taxes, and/or (b) leave the trust subject to invasion as part of the marital estate.
