    Default $175 Ticket for Talking on the Phone

    My question involves a traffic citation from the state of: California

    I got a ticket for talking on the phone / a 23123 VC violation.
    According to the DMV website this ticket shoudl only cost me 20 dollar the first time and adidional 50 dollars for every violation after that.

    On the paper i just received from the Court house it says that i have to pay $175 for this violation.

    Unfortuantly i have received 3 tickets this year and have 1 points on my driver licience but should that be enought to increase a $20 ticket to $175????

    I find it hard to beleive that other violations can increase the 23123 VC violation.

    That does sound high.

    Does it break down the fines and fees?

    Perhaps you should call and ask them to break it down. From the 2008 bail and fee schedule it SHOULD be about $76 for a first offense for 23123(a).

    It does not break down the fees. It just says Bail amount $175

    Would it be considered a second or third offence just because i have received two other minor moving violations within the last 6 months?

    Can i just call the court and ask a clerk to break it down or do I have to show up in court and ask the judge?

    The clerk should be able to break it down for you.

    Does it matter what the breakdown is?? It is a money making scam that feeds on the fears and misconceptions of a sheep-like public. Regardless of the breakdown... he is getting ripped off.

    The breakdown will tell him whether or not the amount is in error. If he tells the court that the fine is too high, that will do precisely ... what??

    Whether you or I - or anyone else - thinks the fine is too high is not the issue here. We can take that up with our respective state legislators.

    I don't think the fine is too high.... I think the law is stupid, ineffective, has nothing to do with public safety and was enacted simply as a money making scam and as a way to pander to constituents who believe cell phones are bad.

    I hope the OP and every other driver ticketed under this insane code challenges it in court and argues it to the point that it costs the State instead of making it.
