    Default Visitation Schedules for a Toddler

    My question involves a child custody case from the State of: NC

    After five years we are seperating, after a domestic violence incident. Yes, I have a protective order and criminal charges are pending. Unfortunately there is a little tyke in the middle of this mess and I am wondering if anyone can tell me what a "typical" visitation schedule is for a 2 1/2 year old. It looks like my hb has agreed for me to have primary custody and now we are working on a schedule. My attorney is good, but I feel that her mantra maybe to be "generous". I don't want to sound ugly but I don't want our son to have too much time with his dad for fear of learning his controlling and violent ways. So I DON'T want to be generous! I want him to get what is typical, ie the minimum!

    I found an example of structured visitation:

    Structured visitation attempts to set out a basic minimum of visitation rights for the non-custodial parent. For the purposes of this illustration, the non-custodial parent is assumed to be the father. Such a provision in an order or a separation agreement might set visitation for a nearby father at:

    A. Every other weekend from 6:00 o'clock Friday until 6:00 Sunday.

    B. December 25 at noon until December 30 at 6:00 o'clock p.m. of every year.

    C. Alternating Thanksgiving and Easter holidays.

    D. Four weeks in the summer if notice is given to mother not later than April 1.

    E. Father's Day of each year regardless of whether it is his weekend or not.

    A more extensive schedule might go on for several pages, containing provisions for "make-up" days, the birthdays of the children, visitation by the mother in the middle of dad's summer visitation with the child, and other matters.

    The ACTUAL minimum acceptable visitation schedule will be determined by the court - it may be stricter than the example, it may be more generous. This is only an example of what one might expect.

    I just got out the same situation. My husband ( now my ex) came after me one night and I had him arrested ( I don't want to go into details) but I asked for supervised visitation which he was given simply because she was in the house while this all happened (alseep but still there) anyhway he had to go to thsi place Family Solutions where they had a visistation monitor with our child. He was given 2 yrs probation, supervised visits and had to attend agnger management and some other class I forget what it was. Anyway 2 yrs later ( this past Feb) I agreed he no longer needed SUperivsed and we took 6 months ( on and off because he couldnt keep a reagular routine) building up to a set visitation which consists of this:

    Mother has sole custody with specific visitation to father as follows:

    First (3) three visits every other Sunday from 12pm until 5pm
    Visits (4) four through (6) six every other Saturday from eleven am until Sunday at 5pm

    Visits (7) forward: every other Friday 5pm unitl Sunday at 6:30pm

    Every other major holiday as parties agree: Major Holidays are, Easter, Thanksgiving, Christmas and the Father's/ Mother's Day as it pertains to each person ie mom gets Mother's Day, dad gets Father's Day.

    Mother gets unhinderedphone access to child during father's visits.


    But I would go in asking for supervised until the impending criminal case and un til he goes to some sort of anger management classes or counseling or something. My ex-husband sid that changed his attitude towards everything so maybe. Hope this helps!!:
