    Default Arizona Foreclosure and Eviction Process

    My question involves an eviction in the state of: Arizona


    My landlord is being foreclosed on in approximately 2 weeks, and I need to know how the foreclosure/eviction process works.

    If the property sells in 2 weeks, will they give me a 30-day notice of eviction, or will I have to vacate that same day!??

    If the property does not sell at auction, what will happen then? Will I be able to buy myself more time to find alternative housing?

    The completed foreclosure terminates your lease, but Arizona's statutes are a bit vague. It appears that they would either have to evict you on a thirty day notice as a holdover tenant, or they would have to try to evict you on a five day notice which would give you the opportunity to pay the rent and nullify the notice. Odds are, though, that the buyer will try to work out a deal with you, particularly if it's a bank.

    You should expect the property to sell.
