    Default Evicting Occupant After Unsuccessful Sale

    I live in michigan


    i need to movie back in my house is this enough ground's to evict beside not paying rent no lease agreement no rental agreement the only agreement we had was verble .

    you see i had my house up for sell these people had no place to live they assured me they could get finanacing so we had to move for my wifes job anyway we agreed you can move in till you get financing then you can buy the house .

    that fell through they said they wast going to try anymore the house was not worth my asking price and were not moving out but my wifes job transferd her back to this city and we need move back in .

    can we evict for breech of verble agreement and the fact we want to take repossision of our own property :?

    Default Evicting Unwanted Tenant

    Under Michigan law, you would be presumed to have a month-to-month tenancy. You need to serve a thirty day notice to quit (form dc100c), and then upon passage of the thirty days file an action to evict them in District Court (preparing both a summons and complaint for filing). The District Court may be able to assist with service, or may be able to suggest a process server. If the tenants show up in court, there may be a hearing or trial. If they don't, you may ask for a default judgment. Most district courts will prepare the judgment of eviction for a pro se plaintiff. (But if you're lucky, they'll move after they are served with the notice to quit, before you have to file suit.)

    You can downlaod forms here, but you may wish to obtain multi-part forms from the District Court Civil Clerk's office instead.

    Default well we won but

    geez what a deal we won the judgement she has 10 days to move out at this point in which i uderstood to happen. the fun part is if in ten days she is not moved we have go back to court and get a eviction order :twisted:
    ill never rent my house ever again it will stay empty first :!:
