    Question What to Say to Creditors when Under Chapter 7

    My question involves bankruptcy in the state of: Mi.

    I went to my bk lawyer Tuesday and started the chapt 7 process. The lawyer said that when a creditor calls, to give them his name and phone # and then hang up.

    When creditors call, I give them my lawyers name and #. But one creditor said "what chapter are you filing - 7 or 13?" to which I answered "7".

    When I told my lawyer this, he said dont tell creditors that because they can still sue me before my filing date (12-1-08). I did NOT tell the creditor my filing date, as far as they know I already filed.

    Why the heck would a creditor sue you if they know you are filing/have filed chapter 7?! Is it true that I shouldnt tell the creditors what chapter I am filing?

    You should do exactly what your attorney told you to do. He knows your financial situation and bankruptcy situation. They would sue you to get a judgement against you that would create more work for him and in return cost you more. You are paying your attorney good money....listen to their advice! If they call again please just tell them that you don't know anything, thats what your paying your attorney for.

    Thanks gigirlie. I never knew it was that sensitive. I feel like an idiot now because I thought since they were asking, if I told them it would stop the calls. I will do as told, give them the lawyers name and # and then hang up.

    That's the way to do it. Even if you are filing chapter 7, a creditor might still get a judgment against you before the filing date. Your lawyer then would have to turn around & see that the judgment is also discharged in the bk.
