    Default Probation Reduction in Minnesota or Skipping Out on Probation

    My question involves criminal law for the state of: MN

    I may not have quite all the details but can get them, I reside in Australia and my boyfriend in MN. I have just left there and now desperately want him to be with me here.

    He is on probation (2 and a half years with one year served) for threats to a landlord (heated argument which in that state is apparently a petty felony) to which he plead out and took probation.

    I have 2 questions, is it possible for a lawyer to have the probation reduced or eliminated or replaced with community service etc.. to be able to get him free earlier than 18 months to be with me? or.....

    If he skips out on his probation and manages to get here with me......can he return to the USA without being arrested? I guess, what I am asking is, can he then only be arrested in MN or do they pursue him federally if he skips out and returns??

    Any advice is appreciated. If you need any more info to give me the right advice, just let me know exactly what is required.

    Question 1: Usually no! Once probation has been granted and the terms defined, it must be served. He might want to discuss any options with his attorney.

    Question 2: No! He skips town and they will issue a warrant for his arrest. They will also revoke his passport so when he attempts to come back to the states.... He'll have a very large legal mess on his hands

    More likely, if entered in the federal system, the warrant would prevent renewal of his passport. There's always a chance of getting picked up at the border if you have an outstanding warrant.

    An argument that the state regards as a felony would typically involve either "terroristic threats" - "I'm going to come back here and kill you" - or a physical attack.

    Yes, the charge is "terrroristic threats" he told the lady he would "get her evicted" which is on her statement, however, she argued that he said he would "get her" and in the end he took the probation plea without admitting guilt as you can not enter a guilty plea without believing u were guilty. So is reducing the probation with a lawyer likely?
