    Unhappy Landlord Not Being Honest and Suing Me

    My question involves landlord-tenant law in the State of: Va

    I am being sued for $700 dollars for breaking my lease and damaging my apt. Damages I did report and took pics of when I moved in. There were almost 100 documented occasions (through codes/compliance, letters and phone records) where my son and I went w/out utilities and the a/c didn’t work at all. I say this bc utilities were included in my rent. My lease states if I can prove negligence full daily rent can be rebated for interruption. I left a month early bc on Labor Day a fire took place on the floor below me. I felt unsafe bc the fire alarms were silenced by management prior, and no one even there was a fire going on. I sat in my apt w/one below me burning for almost 10 min. I have a incident rpt from NNFD affirming silenced alarms and the panel being held together by tape and tweezers. Does this show negligence and what are my chances of a countersue for my utility rebates and deposit? Also pls see my interview with the news station the day after the fire and you can get a idea of the apt that is suing me. Thanks

    You broke your lease, so they can pursue you for breaking your lease. If you caused damage, they can seek to recover for the damage you caused. If they are requesting compensation for things that were damages when you moved in, use your pictures to dispute the claim. If you believe you are entitled to a rent abatement, countersue for a rent abatement.

    I moved bc the manager said I could after codes came in and reinspected my apt and saw the same damages I reported months before. Now she is trying to recant what she said. I feel regardless if she I owe the apts money I am supposed to be owed as well for utility interuption. My lease says if my utilities were interupted for more than 48 hrs I had legal option to terminate but didnt bc I had small children in that school district, etc. I didnt damage anything in that apt. Im not sure what a rent abatement is, can you tell me?
