    Default Do I Have to Comply with the Plaintiff's Attorney's Request?

    My question involves an injury that occurred in the state of: California, San Mateo County.

    I recieved a packet in the mail today from the plaintiff's attorney containing an Interrogatory questionaire, and letters saying "The plaintiff, _______, request that you send the following documents to her attorney's law offices." No where on here does it say it is required by the court. They want things I am not comfortable sharing with them like a copy of my driver's licence, my past moving violations, and my cell phone bill with a copy of all the calls made on the day of the auto accident. They also want me to send them a letter which states that I admit to all the things that happened...this sounds like a trap...

    -If it is my choice I will not send them anything, but will I be in trouble if I don't?

    -And if I won't be in trouble and I choose to not send them any information, should I send them a note denying their request?

    If you don't do it willingly, they'll just go to the judge and get a court order for you to turn these things over.

    They're allowed to ask. It's called Discovery.

    Have you given the things they sent you to your attorney? (If you don't have one, you need to get one. DO NOT try to handle this by yourself.)

    My auto insurance is going to provide my legal defense. I called their offices this afternoon when I checked the mail and will be handing a copy of these ovet tomorrow morning.

    I hear that if I do not provide them with these requested items that they could automatically win?

    Wouldn't it be better to wait for them to have the court soupena(?spelling?) it rather than just hand it over, this way a judge decides what's truly necessary - I don't see why they need a copy of my college transcript.

    Will my legal defense be requesting things from them too?

    Your ins. co. will defend you up to your policy limits. Anything you receive from the plaintiff's attorney, give to the ins. company's lawyer. You should follow the suggestions of your legal defense (ins. co. lawyer). You can also ask them any questions you might have.

    This is normal procedure. Your attorney will do the response. You can object to certain requests but normally you just give them what they ask for.
