    Default Shoplifting Charge vs. Disorderly Persons Offense

    My question involves an arrest warrant from the State of: NJ

    PLEASE HELP ME! I am so worried and I feel so bad too!

    ... but today I have received a communication from the municipality court in which they tell me that they have tranformed my 3rd degree crime (shoplifting) in a Disorderly Persons Offense. Can you answer me if this creates a criminal record? What about this record of Disorderly Persons Offense and my VISA J1\immigration etc... for my future?
    I want to live here in USA, apply for a researcher\professor position. I am finishing the Graduate School, and I am worried about the consequences of my stupid act.
    How can I expunge it? Will be the court clement avoiding to register my criminal record because now it`s a Disorderly Persons Offence?
    I feel so bad, what I have done was shameful.
    With this record (criminal?) can I enter in USA for less than 6 months without a VISA, for example to go to a conference?
    Help me please!

    Most all of us work regular jobs and take time to answer questions as volunteers. Sometimes questions will sit a day or two. Fortunately the law acts slow and methodical. If you want an immediate answer you can call an attorney (you need a criminal defense AND an immigration attorney). ...but will likely have to wait a few days to get in for your initial consultantion.

    You did something stupid and stupidity hurts sometimes.
    Disorderly is a misdemenor; that results in a criminal charge and, upon conviction, a criminal conviction. The court will not be nice to you and not register it. They have apparently been nice in reducing the charges. It's not theft, so that's a positive.

    You may not be able to expunge it, but might not have to report it dependent upon the application since it is not a Felony. Some colleges require ANY arrest or conviction to be noted.

    You should be able to enter the country to visit and for conferences and meetings.

    You likely need a Visa to work or study in the country so please keep that in mind. Answer ALL paperwork HONESTLY. CBP/ICE will definitely find your arrest and conviction record.

    Talk to a lawyer and see what they say. The initial consultation *may* be free and the fee they charge to help you through the process/plea will likely help. They may be able to work a better deal, such as deferred ajudication.
