    Question Visiting a Bankruptcy Lawyer

    My question involves bankruptcy in the state of: Mi.

    I had an appt today with the bk lawyer. Never did get to see him personally, but his legal assistant went through the means test with me and I qualify for chap 7, but by the skin of my teeth. I cannot file until 12-1-08 at this point because a few months I made $100 over the limit for my means (on average). So we have to wait 3 more months and file dec 1.

    The legal assistant told me since Im forfeiting my house, vehicle, and boat to not make any more payments on them from today on. Is this true? It sounds fishy to me. I thought under chapter 7, it was for people who werent behind on their secured debt?

    Also, she also said if I wanted to move out of my house today I can. I also find that strange. I figured I would stay here and get back on my feet, seeing that Im not supposed to make any mortgage payments. Can somebody clear this up for me?

    She's correct, your forfeiting your house, vehicle and boat your trustee will sell it and whatever money collect for it will be distributed, what ever balance you got left to pay will be wipe out under your ch 7. So yeah, don't pay anything else if you plan on filing in Dec.

    Yes you can move out if you want to, as mention above, your giving it up in BK, that is not strange, you can stay there until the bank kick you out, usually you'll get a few months about 3+ months, maybe more.
