    Default Bankruptcy Lawyer Didn't Do His Job

    My question involves bankruptcy in the state of: New York

    hey guys, I feel like I've been cheated by my lawyer. From day 1, after I turn in all my papers, tax, paychecks, all my creditors, my credit report, I did all my homework and turn everything in to him, all he have to do is file the case, which he did.

    After that a long road of contacting him if I got any questions, he's never available, never return my calls, NOTHING, he didn't even showed up to my 341 meeting. Every time I called his secretary keep telling me he's in court or he's out for the week. I paid him $1500 to handle my case, note my case does not include any assets, all I had was credit cards debts and 2 judgments which I provide all the info to.

    When my case was file, garnishment was not stopped on my paycheck, I had to call endless places to finally get them to stop the garnishment after I had faxed them papers that I actually file for BK, then it was stop after my efforts.

    Summary: Since I file my case, BK Lawyer never return any calls, never showed up to the 341 meeting, never try to stop the wage garnishment, I did everything by myself alone. Now I paid $1500 is there a way to requesting some of that money back, or I am just SOL (Sh t out of luck).

    Can I also file complaint with Consumer Affairs and BBB?

    I don't know about getting any of your money back. You would have to sue him.

    You can put in a complaint on a lawyer with your state bar association.

    Edit: Nevermind, I found it. Thank you.

    Can he attempted to sue me for slander, if I report him there, to consumer affairs and BBB?

    Anyone can sue anyone else for anything but that doesn't mean they will win. I don't see anything to sue you for or him winning a lawsuit as long as what you report is the truth. I doubt if the agencies you report him to would even tell him YOU made a report on him. Talk to the agencies & see what they say.

    I guess the moderator did the change in the thread heading.

    I just wanted to add I would call the state bar assoc. first. I'm not even sure the BBB takes complaints against lawyers. I don't think they do.

    A BBB will accept complaints about its members. Law firms may be members, but few join BBB's. The typical process when a complaint is accepted is for the BBB to relay the complaint to the member for a response. Similarly, when grievances are filed with a state bar association, the lawyer gets the opportunity to review the complaint and respond.

    Thanks aaron,

    I'm going to file a complaint with both the BBB and Consumer Affairs. As mention now sure they can do much, but just take the complaint that's fine, as long as I file one with them, I'll be satisfied.

    I'm also going to file a "grievances" you call it with the Bar Association, and see what respond if any, I get from him.

    I don't mind paying the money, but I didn't feel he did anything for me, beside filling out the application and that's it. He was never available to answer any of my questions nor showing up to my 341 meeting.

    I call to get a copy of my file to I can keep it for my record, and I ask if my case was a "no assets bk" he was not available to answer that, and the secretary state I'll have to read the case file and find out.

    Shouldn't the lawyer be available to answer my questions, I mean that's why I paid him. I could of file the case myself, but I went to him for legal advice and didn't get any.
