    Default US Citizen Son to File for a Green Card for Parents

    My son was born in the US, hence he's an American citizen. The thing is, we live in Italy, he's a dual citizen. and he's 6 years old. When and under what circumstances he will be able to file for a green card for me and my wife? We both overstayed for some years before leaving the US. She on a Visa waiver, I on a B2.

    He may file for you when he is 21 - not before. While he may file for siblings, they are in a different visa category and will not be able to have their applications processed with yours. By the time he is able to file, the overstays are unlikely to have an effect, but that will be determined by the laws in effect at that time.

    Check the USCIS website for information on the requirements and process.
