    Default New Hampshire Non-Compete

    My question involves employment and labor law for the state of: New Hampshire

    I was made to sign a contract with a non-compete clause more than 1 year after starting employment with a company. No additional compensation was given in order for me to sign this contract. Is the non-compete clause, or even the contract, enforceable?

    If you signed a contract then it's likely that it's enforceable. Have an attorney review it to be sure.

    Non-competes are enforceable in N.H. if (1) it is no greater than necessary for the protection of the employer's legitimate interest (2) doesn't impose undue hardship on the employee & (3) isn't injurious to the public interest.

    Since we haven't read the agreement, you will need to take it to an employment or contract attorney (as the other responder also suggested) for review & advice.

    Thanks for the help so far.
    It's important to know that if the employer decides to enforce the non-compete clause, I would not be able to obtain employment less than an hour from where I live. I have a 6 month old, and my wife works PT, bringing home about $150/week.

    ONLY an attorney in your state who has read the agreement in its entirety can tell you if it is enforceable or not.
