    Default What Does It Mean When Court Records Show 'WAV'

    My question involves criminal law for the state of: Pennsylvania

    Hello everyone,

    I have 2 counts of Simple Assault. Assault #1 is WAV which means Waived for Court and Offense #2 is Migrated Disposition. Does that means WAV charges are dropped due to Court and Offense #2 are charged? I was 18 when I got charged. I am now 26. You could see my report below.

    This is in Magesterial Court? The entry seems to indicate that you agreed to waive your right to a preliminary hearing, such that the charge was bound over to the trial court for disposition. That is often done when the prosecutor and defendant have reached a plea agreement, to be finalized in the trial court.

    Yes, it was a County charge. Both of them were. Since I plead guilty to it. I didn't have to go for jury trial. What you said, does it mean I still got charged twice or was the WAV charge dropped?

    I really didn't go to Court because I plead guilty so instead they gave me Court costs. As far as I remember I might have or didn't go to Court.

    The PO thought this case was non sense so he let me off on 3 months of unsupervised time. I don't know the name of the Court but it was in Wyoming County, PA (not the state of Wyoming). In Wyoming County Tunkhannock High School grounds was the incident. The kid was joking around with his friend and tried to push his friend and missed and pushed me. The kid that pushed me I pinned him against the lockers. Backed off of him and came back at him and stabbed him an pen. As far as I remember there was an investigation.

    You were in court when you entered your guilty plea. You were in court when you were sentenced.

    I been told I can try to expungement of my records but make sure I hire an Attorney.

    Back in 2000-2001 when I first got charged. The PO spoke to the DA to either lower the charges or drop the charges. The DA said to the PO no way, it won't happen. He tried to lower it to either an M3 or a Summary Offense but it wouldn't happen. The charges are Simple Assault in the M2 (Misdemeanor in the 2nd degree).

    At this point I would say, go with whatever the lawyer consulted told you.

    It was actually the DA at the time and they said NO they won't drop or lower the charges. NOT at all but that was 7 or 8 years ago.

    Have I ever assaulted anyone after those charges? Yes but the people didn't report me and press charges. So I got lucky. Not everyone is nice like that.
