    Angry Passed Up for Promotion

    My question involves labor and employment law for the state of: Kentucky

    Two months ago I put in for a shippers positon at a factory that I work at. The person that was in charge of hiring said that it was between me and another person. We are both crane operators but I also work in the shipping department and have actually been doing parts of the shippers job for two years. the other lady had no shipping experience at all but she got the job because of her seniority. We are a non-Union workplace. Then the job was posted again and I put in for it only to be passed up for a person that didn't apply for the job correctly. I eventually went to Human Resources to see if they would investigate the matter. They did say that seniority cannot be used as a reason for her getting the job. They would take it no further. In my interview with the supervisor for the job he said he was concerned about hiring me because I was friends with a girl he did not like...Huh??? Recently I had a fall at work and went to the hospital. My drug test came back with a false-positive (Lab verified), three days later after they let me come back to work they harrassed me endlessly about having an accident. There was debris where I fell and amazingly it was cleaned up after I fell. Has been there for several days and continued to get worse. My second day back to work they sent me for another drug test they said it was random. But the funny thing is that our random tests are done on site. They took me to the hospital to have mine and immediately sent it to the lab. I am not concerned about the tests but am concerned about why they are testing me so much and no one else has ever had to do this after an accident. I need advise on what to do.

    If you apply for a job incorrectly such that your application is rejected without consideration, you won't get a promotion. It's important to follow all instructions when submitting your application.

    Aaron, I'm not sure OP is the one who didn't apply for the job correctly - seems like another person.

    OP - I don't see anything illegal here unless you were discriminated against due to a protected "class" (ie age, religion, race.)

    When you had the accident at work, did you put in a WC claim?
