My question involves employment and labor law for the state of: Not California
My employer requires me to drive 1600 miles a month making 54 visits to 25 locations and does not pay me for drive time or reimburse me for mileage. Is this legal? I get paid a fixed amount of money for each visit and receive a bonus of 200.00 a month for making all the required visits. This does not cover the cost of gas and wear and tear on my car. I tried to get the company to at least change the bonus to a reimbursement for expenses so it would not be taxed on it, since I buy gas, oil and tires in after tax dollars.
They refused to do this, so at 4.00 a gallon I'm spending about 320.00 a month for gas alone. This does not take in to account the more frequent oil changes that are required and the tires I had to replace 2 years earlier than I would have if I had not taken this job and was still driving less than 10,000 miles a year.
