    Unhappy MIP in Michigan (4 Days from Being 21)

    My question involves criminal law for the state of: Michigan

    I was in the backseat of a friends car when he got pulled over (no ticket) and got arrested in Oakland county for a MIP, blowing a 0.12 and taken to the drunk tank. I got this ticket on 8/14 at 0050 hours, I turn 21 in 8/18. My only other ticket is preforming an illegal left hand turn a year ago. This leads me to a few questions:

    1) Does it matter that I turn 21 in four more days and if so, how will this change my case?

    2) Are there any precautions I can take to help my case?

    3) I go to school away from my hometown (2 hours), does this change anything?

    1. Only if the prosecutor is very sympathetic. Even one day less than 21 is still less than 21.

    2. Precautions? I'm not sure what you mean. A precautionary measure might be, "Don't drink alcohol", but it's a bit late for that.

    2) Last night I went and attended an AA meeting and listened to a speaker talk about alcoholism (I don't have a court date set up yet, I went on my own will). Has anyone ever done something like this?

    3) I'm thinking about checking in with a probation officer for random pbts. Since I live far away will I be warned of when to come or just relocated to my new city?

    Thousands of people have. Some on their own and some court ordered. If you have a problem with alcohol, it may help you. If your going in hope that it will get you off the hook, it probably won't help you much.

    Do you already have a probation officer? If your just trying to contact one for advice, it may be difficult for you...most are very busy with clients.
    Where you need to start is with a consult to a local criminal defense attorney. They know the local prosecutor and are familiar with how the local court deals with MIP. You are not alone, there are tons of kids just like you.
