    Default Associate Theft (First Time)

    My question involves criminal law for the state of: IL

    I'm 19 years old and was arrested yesterday for theft from my place of employment which is a K-Mart, I had stolen 400 dollars in merchandise over a month and was taken in yesterday. I will be returning the items in there entirety. I have no criminal record other than this theft, I am active in my community, and no what I did was wrong. I cannot handle jail, but I here I fine and supervision is the mostly likely punishment.

    The time to worry about jail was before you made decision to steal not after. At this point we dont what (if any) charges will be filed or if it reaches the threshold of felony. I would strongly urge yu to talk to a criminal defense Attorney

    I understand what I did was wrong but I am not a repeat offender I made 1 mistake and understand that is still not ok. I just don't think sending me to prison helps anything, I am getting counseling and amd returning all the merchandise and was very honest about what I took.

    Retail theft of property over $150. is a class 3 felony in IL.

    Retail theft of property under $150 is a misdemeanor the first time, and a class 4 felony the second time.

    You need a very good lawyer.

    eta: a class 3 felony can get you 2-5 years in prison in IL.

    I had googled the law but Christina beat me to it. With charges severly breaking Felony threshold jail is clearly on the table. Talk to an Attorney "before" you meet with your employer or sign anything!

    I thought you stole $400 over the course of a month.

    Was it one mistake or were you stealing several times before you were caught.
