    Default Officer Lied to Magistrate in Traffic Court

    Ok so I went in for an informal hearing and told the magistrate I pleaded responsible with explanation. Told him I would gladly pay the fine and that I had a clean record, made it obvious I wanted probation or atleast some sort of deduction for the points.

    Then out of no where the officer comes in saying he gave me a warning a month prior to this careless driving ticket for the same thing (driving real tired, not paying attention to speed). When I only have seen this officer twice in my life! Night he gave me that official ticket and day of the informal hearing.

    I was real mad after I heard this, because he just lied to make me look worse infront of the magistrate. I turned to the officer and told him "You only pulled me over once, I never got a warning before.". Then he turns and says "Maybe you were sleeping" like an asshole. Magistrate asked for evidence of this "warning", officer said "Don't have any". Magistrate says 190$ fine asessed and that was it. No points deducted or probation, nothing!

    I believe I still have a week to put in an appeal to this. I ask is this still worth fighting for three points?

    What would be the grounds for appeal? You pleaded responsible, and your disposition was consistent with that plea. The magistrate doesn't have to give you a break, and there's nothing that would indicate that the magistrate based the disposition on the officer's statement.

    Well, I feel to me now that it's not about the points anymore, more the principle of the situation. Even though the magistrate was about to lessen my offense. The officer falsely accused me of getting a warning for careless driving a month prior to this ticket which never happened (which changed the magistrates mind). I'm just more upset than anything and I just want some sort of apology from this officer. He was an asshole with me when I got pulled over and an asshole in court.

    Lied right infront of my face and got away with it like nothing. I'll give him the benefit of the doubt and say "maybe" he confused me with some one else. Really though, gut feeling is this cop did it just cause he could and that pissed me off the most. I was always taught, stand up for yourself when you feel something is wrong. I guess you can't win against cops like this one.

    I just needed to vent. I'm a write and letter to this Police Department. Express just how I feel, cause even though it won't probably do jack, it'll make me feel somewhat better.

    What?! A Police Ocifer lying in Court?! Under Penalty of Perjury?! Why, this could NEVER EVER happen!! Truth is…it happens all of the time.

    Conventional wisdom and the LAPD say, "cases like Rodney King rarely happen". That's complete BS - they happen all of the time.

    Conventional wisdom and the LA County Superior Court say, "cases like State v. Orenathal J. Simpson are the exception toi the rule". BS once again. It happens on a daily basis.

    So what do YOU, blewis, have to say or add to the discussion to bring it up to your scholarly standards.
