    Default Texas Auto Repo

    My question involves an auto loan or repossession in the State of: Texas.

    I am thinking of having my auto repossed voluntarialy, I am just got way over my head and cant keep up with everything I have to pay. My question is: If I get the auto repoed and go through the whole ordeal, what can they leagally do to me. I dont have a problem paying back the debt that I owe, I just dont want anything drastic to happen. Can they garnish my wages, bank account, irs refunds. Also I own a home, it is homesteaded though. If they put a lien on my home can they force me to foreclose on it? Any help regarding this would be great. Thank you.

    No. That's not what foreclosure is, anyway. Foreclosure is when your mortgage lender takes back the house for non-payment.

    If your auto lender puts a lien on the house, all that means is the house cannot be sold til the lien is satisfied.

    With respect to your voluntary repo, the car will be sold at auction, and if it sells for less than it is worth, you may be sued for the deficiency.

    If I am unable to make the payments can they put a lien on my hse, even if it is homesteaded? Also can they garnish my bank account?
