    Default Denied Unemployment Due to Personal E-Mail

    My question involves unemployment benefits for the state of: Alabama
    I asked for a half day off. When I asked why I told employer other employees were getting an extra day off with pay for the 4th of July. The 4th was a Friday, my normally scheduled day off this year. Employer got upset and went on a mini rant and last thing they said was just leave and don't come back. So I did. A few days later I sent an e-mail stating I had asked for a raise 3 times and after 3rd no I decided to not ask again and be satisfied with what I got. I also gave an analysis of pay. I was payed a salary that was based on a specific hourly rate for a 40 week. No other salary employee was based on a hourly rate. The end of my e-mail I said no hard feelings and wished them well. Employer sent my e-mail to unemployment. Unemployment was denied, said voluntarily quit because I was dissatisfied with wages. Employer is a family owned franchise business to which I was very close with and well thought of up until that time. Employer has requested letters of resignation from 2 previous employees that left one in Dec. and on in May. I was not asked for a letter of resignation. Not related to unemployment employer has common business practices that are unethical and fraudulent. I was consistently put in position to have to lie and be evasive because of employers choice of business practices. I just sent in requesting my first appeal. In Alabama there are 3 chances to appeal. Do I remind the employer of what they do prior to my appeal to increase my odds of the appeal going in my favor?

    Filing an appeal cost nothing so do so. However since you did quit its likely the employer will prevail. These things are resolved on a case by case basis so we cannot predict outcome. Its possible that employer will not show for appeal hearing and you win by default. File the appeal you have nothing to lose

    Thanks, the 1st appeal in Alabama is done by a 3 way conference call. In a conversation with the employer I had recently, they advised me to appeal and also made the statement to me that it could get ugly. Does that sound like a threat to you?

    Thanks again, the employer does not know that I will get 3 chances to appeal. 1 with an arbitrator, 2 in a circuit court, 3 in state civil court. If I let them know this they will probably not want to pursue it, due to the time and energy and it is a small company with less than 15 employees. Especially if I let them think I plan on pursuing each appeal regardless of the outcome.

    Yes I understand and I am currently looking for a new job and hope to have a new job soon. What I am actually doing in regards to this is just a bluff. I just want them to think I plan on doing this, when I really don't have any intention of going past the first appeal. Thanks for your input CourtClerk.
