    Default Unfairly Denied a Work Vehicle

    My question involves labor and employment law for the state of: Louisiana
    I am a rural mail carrier XXXXXXXXXX. I have been employed here for 20 years. I am hearing impaired and believe I have been discriminated against in regard to receiving a government vehicle for use on my route. Personal vehicles are being replaced by regular govt issue mail trucks and were being assigned by a certain criterea which was mileage (lowest mileage routes first) Finally I was up for a truck, I had problems with my personal vechicle at the time and it needed replacing, so I was using one of the postal spares for a while. I was so happy that a truck was becoming available and I would get it. But due to a decision between our union rep and management they then decided to change the criterea right then and there to Senority. This made sure that I did not receive this vehicle. I was told by the union rep, whom has personal issues with me that I could not file a grievance in this situation. I was told that I must come up with another vehicle or face disiplinary action or expulsion from my job. This occured almost 2 years ago and I had been waiting for years for my turn to finally arrive. Anyway the person who did get the vehicle had a route with far greater mileage and would have been way down the list, favoritism came into play and I was hurt , suffering mental anguish as well as financially from their move. I had also been passed over a few years before, when I was #4 to get 4 vehicles. Mgt. then created a small auxillary route which got vehicle #4. If the senority criterea had been instituted in the beginning I would have had a truck long ago, more than 7 carriers junior to me have trucks. What can I do?

    I'm not seeing how this is discriminatory. Disorganized, but not discriminatory.

    Your employer is not required to provide you with a truck.

    Formerly a Postmaster and seeing the same policies implemented here in MI,I have a suggestion for you. You need to go above the union stewards head. You have rights in the contract and the Postal Service works as such that their actions can not cause harm to a union brother, which you are. You pay union dues as do the rest of the employees, therefor you are entitled to the same rights. I would raise the case that if they are now going by seniority, ou should have had the next truck. Be sure you have an interpreter so your negotiations are understood. You have that right ANYTIME because of your disability. They MUST provide you one. Make some noise or they will stomp all over you. If you were here in MI, this would not be happening to you.
    Make some noise, you nust. It is difficult but that is what you must do sometimes in order to be heard in the Postal Service.

    I have been waiting for many years for a vehicle. I know that the union rep knew fully that I was next in line to get the vehicle. I spoke with her myself about it and she goes behind my back and gets the rule changed. I was out for about six weeks with an injury and no one informed me and when I went in periodically and spoke with the postmaster he just kept mum about what they were doing in regard to the vehicle. It was intentional malicious behavior that it happened the way it did. And when I found out, was told I could not file a grievance. That was another lie. I have been wronged many times as my hearing impairment makes me easy prey. They did not think I would fight back, but I will do whatever it takes to legally right this wrong. And as far as senority goes, that is the way it should have been from the very beginning. The mileage criteria was a joke, all the routes are subdivision routes between approx 19-26 miles. The idea was by giving the low mileage routes vehicles first it would save the postal service money on fuel and wear and tear, but the mileage perimeters I just mentioned would have basically negligable savings. in this area. If Senority would have been the crit, I would have had a truck more than 5yrs ago. They are 100% wrong in what they did to me, causing me to purchase a new truck and deal with the huge increases in fuel costs of which as you well know the EMA is a joke. Favoritism and malicious intent are valid accusations here.
