    Unhappy Getting Emancipated Without Parents' Consent or Cooperation

    My question involves emancipation laws for the State of: Florida


    i am currently 17 years old and pregnant with my first child. i haven't lived with my legal parent for over 3 years. i have a part time job and attend high school on a daily basis. I'm currently staying with a roommate and i pay $100 for room and board a month. I've been trying to get help with insurance for myself and my unborn for the past 2 1/2 months and the medicaid keeps denying me due to the fact I'm not emancipated. My mother believes its not in her control to verify any information needed to proceed with my insurance due to the fact that we haven't lived with each other over 3 years and she lives in a different county. i understand that i cannot proceed with an emancipation without the concent of a parent but my [parent wants nothing to do with my issues. i need to know what i can do to get emancipated so 1 i can apply for health insurance and 2 i wont get in trouble with the law due to me being a minor on my own. i need to know and as soon as possible. please help

    In Florida, if your parents will not sign the emancipation petition then you cannot be emancipated. Period.

    There are no loopholes, no work arounds, no exceptions. No parental permission = no emancipation.

    Were either one of your parents ever ordered to have insurance on you? (perhaps in a dissolution of marriage, or child support order?)

    I believe your parents are responsible for your bills, whether they want to be or not. You may have to speak to an attorney regarding this.

    The OP's parents may or may not be responsible for health care for the OP.

    However, the OP's child is the OP's responsibility.

    So long as the OP is NOT emancipated, wouldn't she simply have any of her (not the baby's) medical bills sent to mom - since mom is still her legal guardian? That assumes of course that as a minor she could even GET non-pregnancy-related treatment without parental consent. When mom starts seeing the medical bills adding up under HER name and hitting HER credit report when they go unpaid, she might least be motivated to share the info about any standing insurance that might be available to the minor.

    But in the big picture, no court is going to emancipate a 17 year old with a child.
