    Default Lawyer Messed Up Case and No One Wants to Take Over Case

    My question involves malpractice by a lawyer in the state of: TX

    Inexperienced lawyer took on case and is no match for the opposing attorney. Won't return phone calls because attorney is not sure what to do. Spoke to 3-4 experienced attorneys. They would have never taken case to court and will not take on case now to finish it. The case has been sitting on the judge's desk for 2 months now with no action.

    I have been told by the other attorneys that I have been grossly overcharged. These are experienced attorneys that could charge me more to work the case. I don't want to pay the current attorney another dime until case is finished.

    Between a rock and hard place. Attorney will not finish case, and has overcharged me and I cannot get another attorney to work case.

    I know I can file a fee dispute when the case is finished. But it looks like it will never be finished.

    Does this have something to do with child custody & visitation as per your other threads (previous threads)? We do need more details as to what type of case you are talking about & what your actual question is. Thanks.

    Its a parent child suit. I didnt want to get into case details. The bigger picture is that the attorney had very little evidence to prove bring the case to court, and then filed it in the wrong state court. The case has been languishing for months. No other attorney wants to touch the case to bring it to closure.

    Find a lawyer in your state who handles legal malpractice cases. Have the lawyer advise you about your situation, including whether you should dismiss the improperly filed lawsuit and cut your losses, and whether you have a potential malpractice claim against the lawyer who filed it.

    I learned our state has a client-attorney grievance process coordinated by the state bar. That may be the best way to go versus hiring another attorney right now.
